The New School Library Electronic Reserves

 

The New School Library's electronic reserves system provides access to supplementary course materials in support of the University's academic mission .

 

 

Fair Use Guidelines

 

The Library's policy governing access to copyrighted materials available via its electronic reserves system, as with all reserves, has been developed in compliance with the United States Copyright Act of 1976, Section 107 which establishes the principle of fair use and allows the making of multiple copies for classroom use. Fair use is determined by the following factors:

 

The purpose and character of the use, including whether such use is of commercial nature of is for nonprofit educational purposes;

The nature of the copyrighted work;

The amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

The effect of the use upon the potential market for and value of the copyrighted work

 

 

 
Access to Electronic Reserves System

 

Access to the electronic reserves system is:

 

Limited to the instructors and students registered for the course and password protected

Available via the course reserve system only

Free of charge except for charges for the actual printing or copying of reserve materials.

 

General Procedures

Materials to be copied or scanned for electronic reserves will be in legal possession of the Library or the faculty member (by purchase, license, fair use, etc.).
All use of materials placed on electronic reserves will be at the initiative of faculty solely for the non-commercial, educational use of students.
  1. Only a small portion of a work can be copied for electronic reserves.
  1. On introductory screens the electronic reserves system displays a copyright notice, consistent with the notice described in section 108 of the Copyright Act:

NOTICE: The copyright law of the United States (Title 17 U.S. Code) governs the making of photocopies of copyrighted materials. The person using this system is liable for any infringement

 

  1. The New School Library will refuse to place materials on electronic reserve if it judges that the nature, scope, or extent of the material exceeds the reasonable limits of fair use.
  1. Access to Materials will be disabled in the electronic reserves system at the conclusion of the course.

 

Electronic copying and scanning of copyright-protected works for library reserve systems and distance learning are, at this point in time, areas of the law without interpretation. They may be addressed by the Supreme Court or future revisions of the copyright law. The New School Library and University Counsel will monitor legal developments concerning fair use in an effort to maintain compliance with U.S. Copyright Law.
